Introduction:

These Standard Terms and Conditions written on this webpage manage your use of this website and contracts with Chris Trento Photography. These Terms will be applied fully and affect to your use of this Website. By using this Website, you agreed to accept all terms and conditions written in here. You must not use this Website if you disagree with any of these Website Standard Terms and Conditions. If agreed otherwise in writing, those agreements override this agreement’s specific part related to that issue, but not the overall agreement.

CLIENT REPRESENTATION:

The Client is responsible for the presence of an authorized representative at the shoot to approve the Photographer’s interpretation of the assignment. If a client representative is not present, the Photographer’s interpretation shall be deemed acceptable. Due to the individual nature of both shooting and edit styles, Photographer will make every attempt to closely match an existing brand or style but makes no guarantee.

Retainer and Payment:

The Client shall pay a retainer fee of 50% of total project price (plus travel expenses where applicable) to secure the date for services and product specified herein. The final balance to be paid the day of the project. The parties agree that if payment is not received in accordance with this provision, Photographer shall be under no obligation to provide Services, nor photograph the project or release images and retainer fee will not be returned to client.

Cancellations:

All deposit fees are non-refundable. A minimum of 5-business days notice is required for cancellation of any Contract by the client. Any cancellation made with less than 5-business days notice prior to the agreed service date will result in full payment by client. If the cancellation is initiated by Chris Trento Photography, payments paid to Chris Trento Photography from client shall be refunded. Refunds are typically paid out within thirty (30) calendar days from the cancellation date.

Any deposits/retainers and payments are non-refundable once any digital images or videos are released.

Copyright:

Copyright to all products, created by the Photographer/Videographer/ and/or subcontractor(s) remain the property of the Chris Trento Photography. Violators of this federal law will be subject to its civil and criminal penalties. Photographer remains author of its creations forever. Author name cannot be replaced under any circumstances. Upon final payment by the client the digital images then become licensed to the client for contracted specified use and for the purpose of reproduction of said imagery.

Photographer may use photos and videos created under this contract for professional samples, displays, Internet website pages, advertising, exhibitions, contests, and any other purpose of Chris Trento Photography. This includes images and behind the scenes taken during the photoshoot.

Any deposits/retainers and payments are non-refundable once any digital images or videos are released.

LIMITS OF LIABILITY:

If the Photographer cannot perform this agreement due to fire, casualty, act of God, illness, or any other cause beyond the control of the Photographer, then Photographer shall return all monies paid and shall have no further liability with respect to this contract. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or memory card malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event that Photographer fails to perform for any other reason, Photographer shall not be liable for any amount in excess of the value of the Clients package.

Indemnification:

Client shall indemnify and hold harmless Photographer from any loss, damage or liability resulting from client’s violation of the terms of this Agreement or any agreement involving the Client and the Photographer.
